1. Agreement to Terms

By accessing and using the Lavish Bites website (www.lavishbites.co.za) and placing orders, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Services. We reserve the right to modify these terms at any time, and your continued use of our website constitutes acceptance of any changes.

2. Use License

Permission is granted to temporarily download one copy of materials (information or software) on Lavish Bites website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile or reverse engineer any software contained on the website
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

3. Disclaimer

The materials on Lavish Bites website are provided on an 'as is' basis. Lavish Bites makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Order Placement & Acceptance

Order Placement: When you place an order on our website, you are making an offer to purchase our products/services. Your order is not binding until we send you an order confirmation via email.

Order Acceptance: We reserve the right to accept or reject any order at our sole discretion. We may refuse orders for any reason, including but not limited to:

  • Unavailable ingredients or menu items
  • Delivery location outside our service area
  • Insufficient delivery time
  • Incomplete or inaccurate information provided

Order Modifications: Orders can be modified within 2 hours of placement. After this period, please contact us via WhatsApp or phone to request changes.

5. Pricing & Payment

Price Accuracy: All prices are listed in South African Rand (R) and are accurate at the time of display. Prices may change without notice.

Payment Methods: We accept payment via:

  • Credit/Debit Cards (Visa, Mastercard)
  • Electronic Funds Transfer (EFT)
  • Mobile Payments

Payment Processing: Payments are processed securely through Stripe. Your card details are never stored on our servers.

Order Total: The order total displayed includes the price of items and any applicable taxes. Delivery charges (if applicable) will be clearly indicated before checkout.

6. Delivery & Fulfillment

Delivery Areas: We currently deliver within Pretoria and surrounding areas. Delivery availability is indicated during checkout.

Estimated Delivery Times: Delivery timeframes are estimates only. We will make reasonable efforts to meet the estimated time but cannot guarantee exact delivery times. Delays may occur due to traffic, weather, or high order volumes.

Order Tracking: You will receive WhatsApp or email notifications regarding your order status and estimated delivery time.

Delivery Refusal: If you refuse delivery of a prepared order, you may be liable for the full order cost.

7. Food Quality & Complaints

Quality Guarantee: All food is prepared fresh using high-quality ingredients. If you receive an item that doesn't meet our quality standards, please report it within 30 minutes of delivery.

Complaint Process:

  1. Contact us via WhatsApp (+27 12 345 6789) with photos if possible
  2. We will assess the complaint and determine appropriate resolution
  3. Resolutions may include: refund, replacement, or credit toward future orders

Allergies & Dietary Requirements: While we take allergen concerns seriously, we prepare food in a shared kitchen. Please inform us of allergies during order placement. We cannot guarantee allergen-free preparation.

8. Refund & Cancellation Policy

Cancellation within 2 hours: Full refund minus any delivery charges

Cancellation 2-6 hours before delivery: 50% refund of order amount

Cancellation less than 2 hours before delivery: Order cannot be cancelled; full charge applies

Post-Delivery Refunds: Refunds for damaged, spoiled, or incorrect items must be claimed within 30 minutes of delivery with photographic evidence.

Refund Processing: Approved refunds will be credited back to the original payment method within 5-7 business days.

9. Chef-for-Hire Services

Booking Process: Chef-for-hire bookings are made via the website contact form or WhatsApp and must be confirmed at least 48 hours in advance.

Event Requirements: Minimum group size is 10 people. Pricing is R150 per person (customizable based on menu and location).

Deposit: A 50% deposit is required to confirm a booking. Balance due before or on the date of service.

Cancellation Policy:

  • Cancellation more than 14 days in advance: Full refund of deposit
  • Cancellation 7-14 days in advance: 50% of deposit retained
  • Cancellation less than 7 days: Deposit is non-refundable

Venue Requirements: The venue must provide adequate space, kitchen facilities, and parking for our team.

10. Limitation of Liability

To the fullest extent permitted by law, Lavish Bites shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

  • Your use or inability to use our Services
  • Delays or failures in delivery
  • Food quality issues (beyond our direct control)
  • Data loss or interruption of service

Our maximum liability for any claim shall not exceed the amount paid for the specific order in question.

11. Intellectual Property Rights

All content on the Lavish Bites website, including text, graphics, logos, images, and software, is the property of Lavish Bites or its content suppliers and is protected by international copyright laws. You may not reproduce, modify, or distribute any content without our express written permission.

12. User Conduct

You agree not to:

  • Use the website for any illegal or unauthorized purpose
  • Harass, threaten, or abuse our staff via any communication channel
  • Attempt to gain unauthorized access to our systems
  • Post false or misleading information
  • Use the website to compete with our business

13. Third-Party Links

Our website may contain links to third-party websites. Lavish Bites is not responsible for the content, accuracy, or practices of these external sites. Your use of third-party websites is at your own risk and subject to their terms and conditions.

14. Data Protection & Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms. By using our Services, you consent to our collection and use of your personal information as described in the Privacy Policy, in compliance with the Protection of Personal Information Act (POPIA).

15. Payment Security & Fraud

Secure Processing: All payments are processed securely through Stripe (PCI-DSS Level 1 compliant).

Fraud Prevention: Lavish Bites reserves the right to investigate and cancel orders suspected of fraudulent activity.

Chargeback Policy: We reserve the right to take legal action against customers who initiate chargebacks without justification.

16. Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

17. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts of South Africa.
